Abstract

This dissertation discusses about the theory of al-muÌÉrabah contract in financing small and medium industri as developed by the classical jurists in their Islamic jurisprudence writings, and its application in the practice of one of Islamic Banks namely Bank Syariah Mandiri Jakarta, Indonesia. Al-MuÌÉrabah is a partnership contract where the capital provider contributes the capital while the manager provides managerial skills to manage the muÌÉrabah capital accordingly. All profit from the investment will be divided between the both parties based on the agreement during the contract, however the loss will be borne solely by the capital provider in the absence of misconduct or negligence or breach of the partnership terms and conditions by the manager. Bank Syariah Mandiri is also practicing other Islamic principles such as al-wÉdiah, al�muÌÉrabah, al-istiÎnÉ, bay’ al-sÉlam, al-ijÉraÍ,etc in its operation, finance and services. This study found out that Bank Syariah Mandiri has practiced the muÌÉrabah principle in deposit account and financing operation which is accordance with Islamic law.
