Abstract

Counterfeiting and Use of False Documents is one of the crimes regulated in the Criminal Code. Specifically for letter falsification, it is regulated in Article 263 and Article 264 of the Criminal Code (KUHP) with a penalty of 6 (six) years in prison. Sometimes someone who uses fake documents does not know the authenticity of the document. This is what creates a dilemma for law enforcement officers. The research method used is normative legal research, namely research is carried out by analyzing applicable laws and regulations. From the research conducted, it is concluded that in positive legal arrangements in Indonesia, there is no difference in criminal liability against parties who use fake documents who know the documents are fake and those who do not know the documents are fake. In the reconstruction of criminal responsibility, it is necessary to consider the aspects of mens rea and actus reus in determining the guilt of the perpetrator of a crime. Thus, the party using the fake document who does not know that the document is fake should not need to be held criminally responsible because of the absence of mens rea and actus reus in their actions.
